- Reconstruction of Rights and Obligations Relations between a State and a Person in the Context of the Extraterritorial Application of Human Rights TreatiesJapan Society for the Promotion of Science：Grants-in-Aid for Scientific ResearchDate (from‐to) : 2021/04 -2026/03Author : 杉木 志帆人権条約は通常、その締約国領域内で適用される。他方で、グローバリゼーションが深化するなか、人権条約は今日、その締約国領域外でも適用可能であるとの理解が確立している。本研究では、人権条約締約国とその自国領域外にいる外国人との間に権力・支配関係がない場合、それにもかかわらず人権条約を適用しようとする近年の人権裁判所の判断や学説について分析を行うとともに、理論的な基礎づけを行う。それにより、人権条約の域外適用において、国と人との間の権利義務関係を再構築しようと試みる。 令和３年度は、人権条約を締約国領域外で適用すべきとする人権裁判所の判例や学説について広く分析を行った。その結果、人権条約の域外適用については、国と人との間の権力・支配関係に基づく国際人権保障システムを基本としつつも、それでは負わすことのできない人権条約上の責任を、国の行為と人に生じた害との間の事実上の因果関係を根拠に加害国側に負わせることで、個人の救済を拡大しようとする動きがあることが明らかになった（国際法学会2021年度研究大会報告（2021年9月7日）にて研究成果の一部を報告）。この動きは、事実上の因果関係に基づく人権保障システムが構築されつつある証拠とみることができる。 また、欧州人権裁判所は原則として国と人との間の権力・支配関係に基づく人権条約の域外適用を認める立場といえるが、国際刑事司法共助の文脈では黙示的に、事実上の因果関係に基づく域外適用を肯定していると評価できることがわかった（人権判例報第3号にて研究成果の一部を報告）。

- 移住労働者とその家族の国際人権保護基準に基づいた法基盤整備の総合的研究Japan Society for the Promotion of Science：Grants-in-Aid for Scientific Research Grant-in-Aid for Scientific Research (B)Date (from‐to) : 2019/04 -2022/03Author : 薬師寺 公夫; 坂元 茂樹; 小畑 郁; 北村 泰三; 徳川 信治; 戸田 五郎; 西井 正弘; 飛田 雄一; 古屋 哲; 前田 直子; 水島 朋則; 有江 ディアナ; 杉木 史帆; 内田 晴子本研究は、①国連移住労働者権利条約やILOの関連諸条約等の国際基準、経済連携協定等の国際約束と対比した関連国内諸法令の比較研究を行い、 ②地方公共団体を含む在留・労働実態との比較検討を行い、 ③在留外国籍者を「移住労働者とその家族」として受け入れる法制度のあり方について、国際人権保障の観点から理論的課題を明確にし、地方公共団体レベルでの課題提起を行うことを目的とする。2020年度は前年度の研究成果を踏まえて、1.国連移住労働者権利条約、ILO諸条約の実施状況の分析、欧州人権条約、シェンゲン協定、欧州連合における移住者関連条項の実施状況の分析 2.日本の法令との対比、3.出入国管理制度、外国人労働者受け入れ政策と2019年導入の新しい入国管理・在留制度の分析 4.技能実習制度などの実態分析 5.地方公共団体の役割と機能の分析の5本の柱をたてて、検討を進め、分担者を2名補充した。 2020年1月以降のCOVID-19のまん延、4月に緊急事態が発令されるに至り、技能実習制度をはじめ人の移動自体が止まる事態に直面し、国際シンポジウムの開催、対面での研究会等が実施不可能になる中、上記5つの柱の4については人の移動の制限と災害時対応に差し替えるなど、5月の研究計画で2020年度の研究計画を一部組み替える緊急対応を行った。研究会も当初予定していた年10回の対面開催はできなかったがオンライン研究会に切り替えるなどの対応をして9回の研究会を開催し、それらの成果の一部は、研究分担者の業績に掲げるとともに、本計画終了後刊行を予定している書籍に収める予定である。国際シンポジウムは当初予定の形では開催できなくなったが、2021年に延期することにした。一部に遅れは出たが、基本的に3年計画に沿って研究を進めている。
- The Significance of Occupation and Military Activities in the Territorial Application of Human Rights TreatiesJapan Society for the Promotion of Science：Grants-in-Aid for Scientific Research Grant-in-Aid for Research Activity Start-upDate (from‐to) : 2017/08 -2019/03Author : Sugiki ShihoThis research project has examined how the territorial scope of human rights treaties is determined in both situations: first, when a State party occupies or conducts military activities outside of its territory and secondly, when a State party has lost effective control over an area of its territory because another state or rebels occupied or conducted military activities. The outcome of this research demonstrates that a State party obliges to protect listed rights in a human rights convention to persons in an occupied area because an occupying power has physical control over this area in the first situation. A State party also obliges to protect listed rights to persons in an area over which the legitimate government has lost its effective control because the government still maintain the competence to govern this area in the second situation. This project clarifies the legal effects of an occupation or armed activities in the territorial application of human rights treaties.
- Research for the Theory Regulating the Personal/Spatial Application of International Human Rights TreatiesJapan Society for the Promotion of Science：Grants-in-Aid for Scientific Research Grant-in-Aid for Research Activity Start-upDate (from‐to) : 2013/08 -2015/03Author : SUGIKI ShihoThis research project has examined in which situation international human rights treaties can be applicable, from the both perspectives of personal jurisdiction and spatial jurisdiction exercised by a state party to certain international human rights treaty. This project especially focused on analyzing the practices of the monitoring bodies for the European Convention on Human Rights, American Declaration of the Rights and Duties of Man and the American Convention on Human Rights. Based on the results of these examinations, this project has clarified part of the theory for the scope of application of international human rights treaties, which determines to whom a state party obliges to secure the rights and freedoms under the above international human rights treaties.
- 人権条約における人権概念の理論的枠組みの構築 －人権条約の域外適用問題を通して－Japan Society for the Promotion of Science：Grants-in-Aid for Scientific Research Grant-in-Aid for JSPS FellowsDate (from‐to) : 2011 -2012Author : 杉木 志帆本研究では、第一に、人権条約がその締約国の領域外で例外的に適用される範囲を確定し、第二に、何故、第一の研究で得られた範囲まで人権条約が域外適用されるのかを理論的に明らかにすることを目的とする。 第一の研究課題について、平成24年度は欧州人権条約についてさらに学説整理と判例研究を深め、欧州人権委員会及び欧州人権裁判所の決定・判決から導き出される域外適用基準をより精緻化するよう務めた。その結果、締約国が、人権を侵害されたと主張する個人の処遇について直接決定を下したわけではない場合、すなわち、当該個人の処遇について対処能力を有さない場合には、原則として域外適用は認められないことが明らかとなった。他方、2011年のAl-Skeini対英国事件判決のように締約国が自国領域外の地域を実効的に支配する場合には、締約国が特定の個人の処遇について対処能力を持たない場合にも、例外的に域外適用が可能となることが導き出された。 これを踏まえ第二の研究課題では、欧州人権条約上の管轄の範囲が、締約国の対処能力の有無という基準によって、すなわち締約国と個人との間の関係性によって決定されることは理論的に妥当であるかどうかについて検討を行った。そのため、一般国際法上の管轄権(jurisdiction)概念と欧州人権条約上の管轄(jurisdiction)概念との間に何らかの連関があるのかどうかという点について特に考察を行い、ある程度肯定的な示唆を得た。 以上の成果は、国際法研究会において口頭にて発表を行った。これに加えて、平成24年度は、自由権規約委員会見解に関する評釈1本と国内重要判例の英訳1本を公表した。
