Prevent recidivism is one of the most important targets in the recent criminal policy. The vulnerable such as the psychiatric patients with substance dependence released from prisons have many problems to rehabilitate because the treatment or the support they need is not available. The researches were conducted towards (1)the designated hospitals under the Medical Treatment and Supervision Act, (2)the halfway houses after imprisonment, (3)related institutions such as probation offices, prisons, prefectural mental health center, (4)so-called “support system at the entrance of criminal justice ” for the vulnerable suspects, and to compare (5)the Dutch system of psychiatric offenders (TBS system), (6) the community service as a criminal punishment and (7)probation service.
Not only the medical treatment but also the continuous and seamless support after release are important to prevent recidivism, and a variety of support besides imprisonment should be advanced in Japan.

In such a case, criminal regulations could include the introduction of penalties for cases in which clinical research lacks substantive justification requirements, i.e., when it is conducted without satisfying the requirements of subject consent, medical justificaion, and medical indications (lege artis) . Furthermore, with regard to procedural requirements, penalties should also be established for cases that infer the non-fulfillment of the substantive requirements described above.

It is difficult to justify “diseased donor transplantation” as legally permitted medical treatment from a viewpoint of criminal law theory. Therefore, it is proper for the method to be performed only as clinical research which is as provided in the administrative guideline of the Ministry of Health, Labour and Welfare. However, the new approaches of extended (or expanded) criteria donor or marginal donor taken in some foreign medical societies seem to be suggestive for this problem. These are being expected to contribute to solving the organ shortage crisis. Further studies are needed to analyze the relation between the medical indication (proper purpose) or medical adequacy (lege artis) of“diseased donor transplantation”and the new approaches.

The Medical Treatment and Supervision Act (MTSA) in Japan effective since 2005 does not solve all the problems to treat psychiatric patients who commit heavy crimes such as murder or arson, rape. For instance, in Japan, the mentally retarded, the developmental disordered, and persons with dementia who committed crimes and need special attention or care are treated not in the specialized hospitals under the MTSA but in the prisons in the ordinary discipline. However, some countries have the multidisciplinary system in cooperation with criminal justice and welfare for the mentally ill and (forensic) psychiatry to treat such persons. We compare the several systems in other countries and to conclude that we can learn the system from the Netherlands in many ways.
